These Terms of Service ("Terms") govern your use of the Atlas Metrics website (atlasmetrics.ca) and our AI automation services. By accessing our website or using our services, you agree to these Terms.

1. Services

Atlas Metrics provides AI-powered automation services for local businesses, including but not limited to:

Missed call text-back automation
AI text/chat response systems
Automated review request sequences
Appointment booking and reminders
Lead capture and CRM management
Custom workflow automation

Services are provided on a subscription basis with a one-time setup fee and monthly retainer as outlined in your service agreement.

2. Text Messaging (SMS/MMS)

Our services include automated text messaging. By providing your phone number and consenting to receive messages, you agree to our SMS Terms & Conditions. Key points:

Message and data rates may apply
You can opt out at any time by replying STOP
Reply HELP for assistance
Message frequency varies
Some responses are AI-generated

3. User Responsibilities

When using our services, you agree to:

Provide accurate and complete information
Not use our services for unlawful purposes
Not attempt to interfere with or disrupt our systems
Comply with all applicable Canadian and local laws
Obtain proper consent from your customers before enabling automated messaging on their behalf

4. Intellectual Property

All content on atlasmetrics.ca, including text, graphics, logos, and software, is the property of Atlas Metrics or its licensors and is protected by Canadian and international copyright laws. Automation workflows built for clients remain the property of Atlas Metrics and are licensed to the client for the duration of their service agreement.

5. Limitation of Liability

Atlas Metrics provides services "as is" and makes no warranties regarding the continuous, uninterrupted, or error-free operation of AI systems or automation workflows. We are not liable for:

Damages arising from service interruptions or delays
Inaccurate AI-generated responses
Lost revenue from system downtime
Actions taken by third-party services (GoHighLevel, carriers, etc.)

Our total liability is limited to the amount paid for services in the 3 months preceding the claim.

6. Service Agreement & Cancellation

Client service agreements have a minimum 3-month term. After the initial term, either party may cancel with 30 days written notice. Setup fees are non-refundable. Monthly retainers are billed in advance and are non-refundable for the current billing period.

7. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information in compliance with PIPEDA.

8. CASL Compliance

We comply with Canada's Anti-Spam Legislation (CASL). All commercial electronic messages sent through our systems include proper sender identification, a physical mailing address, and a functioning unsubscribe mechanism. Messages are only sent with implied or express consent as defined by CASL.

9. Modifications

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes will be resolved in the courts of Ontario.
